  1. About Kafihost - Agency Status


Kafihost ("we", "us", "our") operates solely as an online travel agency and booking platform. We are NOT a tour operator, travel operator, accommodation provider, or adventure activity provider. We act exclusively as an intermediary agent connecting travelers ("you", "the user", "the guest") with independent third-party service providers including but not limited to local homestay hosts, tour guides, trekking operators, and transportation providers (collectively "Service Providers").


By using this platform, you acknowledge and agree that Kafihost does not own, operate, manage, supervise, or control any accommodation, transportation, tour, trek, activity, or any other service listed on this platform. All services are provided independently by third-party Service Providers who are independent contractors and not employees, agents, or partners of Kafihost.


  1. Limitation of liability


Nothing in these Terms excludes or limits our liability for: (i) fraud or fraudulent misrepresentation; or (ii) any matter for which it would be unlawful to exclude or restrict liability under the Consumer Rights Act 2015 or the Unfair Contract Terms Act 1977, including liability for personal injury or harm caused by our own negligence.


Subject to the above, and to the maximum extent permitted by applicable law, Kafihost, its directors, officers, employees, agents, affiliates, and licensors shall not be liable for:


(a) Any personal injury, illness, disability, or bodily harm sustained by you or any member of your party during or in connection with any service booked through this platform, where such injury or harm is caused by an independent third-party Service Provider and not by Kafihost's own negligence;


(b) Any loss, theft, damage, or destruction of personal property, luggage, equipment, or belongings;


(c) Any indirect, consequential, or special loss (including loss of profits, loss of enjoyment, or wasted expenditure) even if foreseeable; (d) Any loss or damage arising from natural disasters, extreme weather, avalanches, floods, earthquakes, landslides, or other events beyond reasonable control;


(e) Any loss arising from civil unrest, political instability, government actions, border closures, or force majeure events;


(f) Any negligence, misconduct, or breach of duty by any independent Service Provider;


(g) Any failure by Service Providers to deliver the described services;


(h) Any medical emergencies, altitude sickness, or health conditions arising from travel to high-altitude regions.


In no event shall Kafihost's total liability to you for direct losses exceed the amount of platform service fees actually received by Kafihost in connection with your specific booking.


  1. Limitation of liability


It is strongly recommended — and for certain adventure activities, a requirement — that you obtain comprehensive personal travel insurance BEFORE completing any booking through Kafihost. By agreeing to these Terms, you confirm that you have, or will obtain prior to travel, adequate insurance coverage that includes as a minimum:


(a) Emergency medical and hospital treatment including evacuation and repatriation;


(b) Emergency helicopter rescue and mountain rescue operations;


(c) Personal accident cover including permanent disability;


(d) Trip cancellation and curtailment cover;


(e) Loss, theft, or damage to personal belongings and equipment;


(f) High-altitude trekking and adventure activities (if applicable);


(g) Travel delay and missed connections;


(h) Personal liability cover.


Kafihost accepts NO responsibility whatsoever if you travel without adequate insurance. Any costs arising from medical emergencies, evacuation, rescue operations, or repatriation will be entirely your own financial responsibility. You are strongly advised to read your insurance policy carefully and ensure it covers all activities you intend to undertake.


KAFIHOST IS NOT AN INSURANCE PROVIDER AND DOES NOT PROVIDE ANY FORM OF INSURANCE COVERAGE.


  1. Adventure Activities and Inherent Risk


Northern Pakistan is a region of extreme geographical and climatic conditions. Trekking, mountaineering, camping, and other activities offered through our platform carry significant inherent risks including but not limited to:


- Altitude sickness (Acute Mountain Sickness, HACE, HAPE) which requires prompt attention


- Extreme weather conditions including sudden storms, blizzards, and sub-zero temperatures


- Avalanches, rockfalls, and landslides


- Flash floods and river crossings


- Remote terrain with limited or no access to medical facilities


- Wildlife encounters


- Physical exhaustion and injury from terrain


By booking any service through Kafihost, you voluntarily assume all such inherent risks. You confirm that you are physically fit and medically capable of undertaking the booked activities. You agree that Kafihost bears no responsibility for any harm or injury arising from such risks.


You acknowledge it is your sole responsibility to assess your own physical fitness, consult with medical professionals before undertaking high-altitude treks, and make informed decisions about activities.


  1. Service Provider Responsibility


The Service Providers listed on our platform are independent businesses or individuals. Kafihost does not:


(a) Guarantee the accuracy, completeness, or reliability of any listing, description, photograph, or review on this platform;


(b) Verify, endorse, or warrant the qualifications, licenses, certifications, or capabilities of any Service Provider; (


(c) Guarantee the quality, safety, fitness for purpose, or legality of any service offered;


(d) Accept responsibility for any misrepresentation by a Service Provider;


(e) Act as guarantor for any booking or service.


Any dispute arising between you and a Service Provider must be resolved directly between you and that Service Provider. Kafihost may, at its sole discretion, attempt to assist in mediation but is under no obligation to do so and accepts no liability for the outcome.


  1. Booking, payments, and cancellation policy


BOOKINGS: All bookings are subject to availability and confirmation by the Service Provider. A booking is only confirmed once you receive written confirmation. Kafihost reserves the right to cancel or modify any booking where errors, technical faults, or pricing mistakes have occurred.


PAYMENTS: Payments made through this platform are processed securely. Service fees paid to Kafihost are non-refundable in all circumstances unless otherwise stated in writing.


CANCELLATION BY YOU: - Cancellations made more than 30 days before the start date: Subject to Service Provider's individual cancellation policy. Kafihost service fees are non-refundable. - Cancellations made 15–30 days before: A minimum of 50% cancellation charge may apply depending on the Service Provider's policy. - Cancellations made 0–14 days before: No refund. Full charge applies. - No-shows: No refund. Full charge applies.


CANCELLATION BY SERVICE PROVIDER: If a Service Provider cancels your booking, Kafihost will endeavor to assist you in obtaining a refund or alternative arrangement from the Service Provider directly. Kafihost does not guarantee any refund and is not liable for any costs arising from such cancellations.


FORCE MAJEURE & UNFORESEEN CIRCUMSTANCES: No refunds will be issued due to events beyond the control of Service Providers including but not limited to: natural disasters, government travel bans, extreme weather, border closures, civil unrest, or epidemic/pandemic outbreaks.


REFUND PROCESSING: Where refunds are approved, processing may take 10–21 business days and is subject to the payment processor's terms. Kafihost accepts no liability for delays in refund processing.


  1. Health, Fitness, & Medical Responsibility


You are solely responsible for ensuring that you are in adequate physical and mental health to undertake the activities booked. You must:


(a) Consult a qualified medical professional before traveling to high-altitude destinations;


(b) Disclose any pre-existing medical conditions to your guide or host upon arrival;


(c) Carry all necessary prescription medications and medical equipment;


(d) Be aware that medical facilities in remote regions of Northern Pakistan may be extremely limited or unavailable;


(e) Understand that helicopter evacuation may be required in emergencies and such costs may be extremely high.


Kafihost accepts no responsibility for any health complications, medical emergencies, or medical costs arising during your trip. You agree to indemnify and hold harmless Kafihost from any claims related to your health or medical condition.


  1. Indemnification


You agree to fully indemnify, defend, and hold harmless Kafihost and its directors, officers, employees, contractors, agents, licensors, service providers, and successors from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to:


(a) Your use of the platform or any services booked through it;


(b) Your violation of these Terms and Conditions;


(c) Your violation of any third-party rights including those of Service Providers;


(d) Any damage caused by you to property owned by a Service Provider or third party;


(e) Any personal injury caused to a third party by your actions or negligence; (f) Any breach of applicable laws or regulations by you.


  1. User Conduct and Responsibilities


You agree that you are responsible for your own behaviour and that of all members of your travelling party at all times. You must:


(a) Respect local customs, traditions, and religious practices;


(b) Follow all instructions given by guides, hosts, and local authorities;


(c) Not engage in any illegal activities during your travel;


(d) Not damage or destroy any property belonging to hosts, guides, or local communities;


(e) Not engage in behaviour that is offensive, abusive, or threatening to Service Providers or local communities;


(f) Comply with all applicable Pakistani laws and regulations;


(g) Obtain all required permits, visas, and documentation for restricted areas.


Kafihost reserves the right to cancel or terminate any booking without refund if you engage in conduct that is deemed harmful, illegal, or disrespectful.


10. Privacy and Data


Kafihost is registered as a data controller in the United Kingdom. We process your personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.


Your personal data is collected and used solely for the purpose of facilitating your booking and providing our platform services. Your data may be shared with Service Providers in Pakistan solely to fulfil your booking. We do not sell your personal data to third parties.


International transfers of your data to Pakistan are made under appropriate safeguards in accordance with UK GDPR requirements. Data is stored securely and retained only as long as necessary for the purposes for which it was collected.


You have the right to access, correct, delete, or restrict processing of your personal data. To exercise any of these rights, please contact us directly.


11. Intellectual Property


All content on this platform including text, photographs, graphics, logos, and software is the intellectual property of Kafihost or its licensors and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our prior written consent.


  1. . Dispute Resolution & Governing Law


These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Both parties submit to the exclusive jurisdiction of the courts of England and Wales to settle any dispute or claim arising out of or in connection with these Terms.


If you are a consumer based in the UK, you also have the right to use the UK's Alternative Dispute Resolution (ADR) services and may refer complaints to an accredited ADR provider.


Any dispute should first be raised directly with Kafihost in writing. We will endeavour to resolve complaints within 28 days. If unresolved, either party may seek resolution through the courts of England and Wales.


You agree that any legal claim must be brought within six (6) years of the event giving rise to the dispute, in accordance with the Limitation Act 1980.


  1. . Amendments to terms


Kafihost reserves the right to amend these Terms and Conditions at any time without prior notice. The most current version will always be posted on this platform. Your continued use of the platform following any amendments constitutes your acceptance of the revised terms. It is your responsibility to review these terms periodically.


  1. . Entire Agreement, Consumer Rights & Severability


These Terms and Conditions constitute the entire agreement between you and Kafihost with respect to your use of this platform and supersede all prior agreements, representations, and understandings. If any provision of these Terms is found to be unenforceable or invalid under applicable law (including the Consumer Rights Act 2015 or Unfair Contract Terms Act 1977), that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.


If you are a consumer in the UK, you have statutory rights under the Consumer Rights Act 2015 that cannot be excluded or limited by these Terms. Nothing in these Terms affects those rights.
